CIPC to Suspend Licenses for Non-Compliance with Business Rescue Reporting
The Companies and Intellectual Property Commission (CIPC) has issued a Practice Note 2 of 2025 warning that Business Rescue Practitioners (BRPs) who fail to submit their required monthly progress reports will have their licenses suspended or revoked.
Under Section 132(3) of the Companies Act of 2008, practitioners must submit monthly progress updates if business rescue proceedings last more than three months. Despite previous warnings, the CIPC has found ongoing non-compliance.
Key takeaways:
BRPs must immediately ensure their reports are up to date.
The CIPC will publish a list of non-compliant practitioners.
Failure to submit reports will now result in suspension or revocation of BRPs license.
BRPs with outstanding reports will not have their license renewed.
Business rescue practitioners should rectify any reporting backlogs to avoid serious consequences.
